5. Quotes, Estimates, and Services
Any prices, quotes, or estimates provided through the Site or our communications are for general informational purposes, are based on the information available at the time, and are not a binding offer. Final pricing, scope, and scheduling are confirmed directly with you before work begins and may vary based on an on-site assessment, site conditions, or changes you request. Nothing on the Site constitutes a guarantee of results, availability, or a specific outcome.
6. Account Registration
If we make account features available and you create an account, you agree to provide accurate and complete information, to keep it current, to maintain the confidentiality of your login credentials, and to be responsible for all activity under your account. Notify us promptly at [email protected] of any unauthorized use.
7. Intellectual Property
The Site and all content made available through it — including text, graphics, images, logos, trademarks, designs, and software (the "Content") — are owned by Superior Truck & Trailer Repair or its licensors and are protected by intellectual property laws. Except for the limited license in Section 3, no rights are granted to you by implication or otherwise. Our name, logo, and marks may not be used without our prior written permission.

If you submit reviews, comments, photos, testimonials, ideas, suggestions, or other materials to us through the Services ("Submissions"), you grant Superior Truck & Trailer Repair a non-exclusive, royalty-free, worldwide, perpetual, irrevocable, sublicensable, transferable license to use, reproduce, modify, publish, and display those Submissions in connection with our business, including for marketing, consistent with our Privacy Policy. You represent that you own or have the rights necessary to grant this license and that your Submissions do not violate the rights of any third party or any applicable law.
9. Email Communications
By providing your email address, you agree to receive transactional emails such as responses to inquiries, confirmations, and service-related messages. You may also receive marketing emails if you opt in or as otherwise permitted by law. You can opt out of marketing emails at any time using the unsubscribe link in any marketing email or by emailing [email protected].

11. Privacy
Our collection, use, and sharing of personal information is described in our Privacy Policy, available at privacy.superiortruckandtrailer.net. By using the Services, you acknowledge that you have read the Privacy Policy.
12. Third-Party Services and Links
The Services may contain links to, or embedded content from, third-party websites and services (for example, scheduling tools, chat widgets, mapping, social media, or video platforms). We do not control and are not responsible for the content, products, services, or practices of those third parties. Your interactions with them are between you and the third party, and you should review their terms and privacy policies.
13. Disclaimer of Warranties
THE SERVICES AND ALL CONTENT ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY CONTENT WILL BE ACCURATE OR RELIABLE.
14. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL Superior Truck & Trailer Repair OR ITS OWNERS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICES WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US FOR THE APPLICABLE SERVICE IN THE 12 MONTHS BEFORE THE CLAIM, OR ONE HUNDRED U.S. DOLLARS ($100). SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.
15. Dispute Resolution and Arbitration; Class-Action Waiver
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT AND TO HAVE A JURY HEAR YOUR CLAIMS.
a. Informal resolution. Before starting any formal proceeding, you and we agree to try to resolve any dispute informally. Send a written notice describing the dispute and the relief sought to [email protected] (subject line: "Notice of Dispute"), and the parties will attempt in good faith to resolve it for at least 60 days.
b. Binding individual arbitration. Except as provided below, any dispute arising out of or relating to these Terms or the Services that is not resolved informally will be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its applicable rules, rather than in court. The arbitration will be conducted by a single arbitrator in the state of Kentucky, or by phone, video, or document submission as the arbitrator directs. Judgment on the award may be entered in any court of competent jurisdiction. The Federal Arbitration Act governs this section.
c. Class-action waiver. YOU AND WE AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS, COLLECTIVE, OR REPRESENTATIVE PROCEEDING.
d. Small claims and equitable relief. Either party may bring an individual claim in small claims court if it qualifies, and either party may seek injunctive or equitable relief in court to protect its intellectual property or confidential information.
e. 30-day opt-out. You may opt out of this Section 15 (other than the equitable-relief provision) by sending written notice within 30 days of first accepting these Terms to [email protected] (subject line: "Arbitration Opt-Out") or to 3816 Bishop Ln Suite 100 Louisville, Kentucky 40218. The notice must include your name, address, and a clear statement that you wish to opt out of arbitration and the class-action waiver. Opting out will not affect any other part of these Terms.
16. Governing Law
These Terms are governed by the laws of the State of Kentucky, without regard to its conflict-of-law principles. For any disputes not subject to arbitration, the parties consent to the exclusive jurisdiction of the state and federal courts located in Kentucky, except as otherwise required by applicable consumer-protection law.
17. Changes to These Terms
We may update these Terms from time to time. The updated version will be posted with a new "Last Updated" date. Your continued use of the Services after the changes take effect means you accept the revised Terms. If you do not agree to the changes, you must stop using the Services.
18. General Provisions
These Terms, together with our Privacy Policy, are the entire agreement between you and us regarding the Services and supersede any prior agreements. If any provision is found unenforceable, it will be limited or removed to the minimum extent necessary, and the remaining provisions will stay in effect. Our failure to enforce any right is not a waiver of that right. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets. Nothing in these Terms creates a partnership, agency, or employment relationship between you and us.
